SB 1591 Summary

• Prohibits commercial pet breeders from locating within 2,500 feet of public or private schools or licensed day care facilities in municipalities with populations exceeding 300,000.

• Grandfathers existing commercial pet breeders that were lawfully operating and fully compliant with all licensing, permitting, and zoning requirements prior to the effective date.

• Prevents public officers and employees from issuing licenses, permits, approvals, or consents for new commercial pet breeders that would violate the 2,500-foot distance requirement.

• Authorizes enforcement by any public officer or aggrieved person through civil injunction suits in district court, and allows municipalities to enact ordinances with municipal court prosecution for violations.

• Defines "commercial pet breeder" by reference to Section 30.2 of Title 4 of the Oklahoma Statutes, with an effective date of November 1, 2014.
