SB 1739 Summary

• Amends 21 O.S. 2011, Section 533 regarding duties of peace officers and jail/prison contractors to receive and fingerprint prisoners, with exceptions for emergency medical treatment.

• Persons needing emergency medical treatment for life-threatening injuries or conditions that threaten loss or use of a limb must be taken directly to a medical facility rather than first being booked into custody or fingerprinted.

• After receiving medical care, the person shall be released from the medical facility and the arresting agency must deliver the person to a facility designated by the sheriff for receiving the person.

• Responsibility for payment of emergency medical costs is assigned solely to the person in custody, except when the condition results from injury caused by a peace officer acting outside the scope of lawful authority.

• Effective date: November 1, 2014.
