SB 1788 Summary

• Amends 59 O.S. 2011, Section 588 to establish civil administrative penalties for practicing optometry without a valid license issued by the Board of Examiners in Optometry.

• Creates penalties of at least $100 but not more than $2,500 per instance of unlicensed practice, enforceable after notice and opportunity to be heard under the Board's rules and the Administrative Procedures Act.

• Prohibits dispensing, supplying, fitting, or adapting contact lenses without a full contact lens prescription from licensed optometrists, physicians, or other authorized professionals; exempts licensed physicians and authorized business entities from these penalties.

• Allows the Board to enforce administrative orders and settlement agreements in district court of Oklahoma County; permits judicial review through the Oklahoma Administrative Procedures Act; requires all civil penalty revenue be deposited into the Board's operational account.

• Effective November 1, 2014.
