SB 1905 Summary

• Health care providers' failure to comply with or breach of the Patient Protection and Affordable Care Act (Public Law 111-148) and related provisions cannot be admitted as evidence in medical liability actions in Oklahoma.

• Violations or non-compliance with the Affordable Care Act and associated regulations, programs, and guidelines cannot be used to establish the standard of care in medical malpractice cases.

• Such violations cannot serve as a legal basis for presuming negligence in medical liability actions.

• Creates new codification in Oklahoma Statutes as Section 1-1712 of Title 63.

• Effective date: November 1, 2014.
