SB2104 Summary

• Requires private prison contractors operating facilities in Oklahoma with more than 100 beds to pay an annual registration fee calculated as 5% of the average daily per diem rate from federal and other state contracts, multiplied by 365 days and facility bed capacity.

• Registration fees must be paid quarterly to the Oklahoma State Treasurer with 12% annual interest assessed on late payments.

• Establishes the Prison Management Revolving Fund in the Office of the State Treasurer for the Administrative Office of the Courts to receive and manage the registration fee revenue.

• Directs fund expenditures toward outpatient substance abuse treatment, drug court programs, split sentences, community sentences, and parole services for individuals eligible for alternatives to incarceration.

• Takes effect July 1, 2014, with an emergency declaration allowing immediate implementation upon passage and approval.
