SB2111 Summary

• Amends 47 O.S. 2011, Section 11-902 to remove the provision making it unlawful to drive with any amount of Schedule I controlled substances or their metabolites in the body within two hours of arrest.

• Retains existing DUI prohibitions for drivers with blood/breath alcohol concentration of 0.08% or higher and those under the influence of alcohol or other intoxicating substances.

• Maintains criminal penalties for DUI violations including imprisonment, fines, mandatory substance abuse assessment and evaluation, and ignition interlock device requirements based on offense severity.

• Eliminates former subsection 3 (Schedule I drug metabolites) while keeping subsection numbering for remaining prohibited conditions (alcohol, intoxicating substances, combined influence).

• Declares an emergency to make the act effective immediately upon passage and approval.
