SB 2140 Summary

• Amends 22 O.S. Section 18 to expand expungement eligibility categories for criminal records, including new provisions for dismissed charges and deferred judgments

• Reduces waiting period from two (2) years to one (1) year for misdemeanor charges dismissed after successful completion of deferred judgment or delayed sentence

• Establishes that offenses arising out of the same transaction or occurrence count as one conviction when seeking expungement under provisions for misdemeanor or nonviolent felony convictions

• Defines expungement as sealing of criminal records and specifies that records sealed under certain provisions remain accessible to law enforcement and the Pardon and Parole Board

• Allows sealing of Pardon and Parole Board records related to pardon applications for individuals with certain pardons or convictions

• Effective November 1, 2014
