SB 362 Summary

• Amends sentencing provisions in 22 O.S. 2011, Section 991a to add new sentencing power allowing courts to order persons convicted of operating a motor vehicle while under the influence of alcohol to abstain or refrain from consuming alcohol, with notation on their driver license.

• Adds new prohibited acts in 37 O.S. 2011, Section 537 making it unlawful to knowingly sell, deliver, or furnish alcoholic beverages to a person ordered to abstain from consuming alcohol, and prohibits persons with such court orders from purchasing alcoholic beverages.

• Establishes penalties in 37 O.S. 2011, Section 538 for selling alcoholic beverages to persons ordered to abstain (felony: $500-$1,000 fine and/or up to one year imprisonment).

• Requires the Department of Public Safety in 47 O.S. 2011, Section 6-111 to develop procedures for issuing replacement driver licenses and identification cards bearing the designation "Alcohol Restricted" for persons subject to court orders to abstain or refrain from consuming alcohol.

• Effective date: November 1, 2013.
