Senate Bill 745 Summary

• Secretary of State Election Board authorized to declare election emergency when voting devices cannot be used or when natural/manmade emergencies make compliance with election laws impossible or unreasonable.

• Secretary of State Election Board and Adjutant General required to develop contingency plan for major election emergencies by January 1, 2014, with updates as deemed necessary.

• Plan shall establish procedures for Secretary to request Oklahoma National Guard assistance during declared election emergencies with Governor approval.

• National Guard assistance provided under this authority is exempt from violations of Section 16-113 and relevant provisions of the Oklahoma Constitution.

• Effective date: November 1, 2013.
