SB 854 Summary

• Requires all new collective bargaining agreements for public employees to include a provision prohibiting the agreement from applying to police officers terminated for using excessive force in the performance of their duties.

• Allows police officers terminated for excessive force to petition the district court for relief and appeal their termination.

• An officer may be eligible for reinstatement if the court determines the termination was based on arbitrary, capricious, or other legally prohibited grounds.

• Applies to collective bargaining agreements entered on or after the effective date of the act.

• Effective date: November 1, 2013.
