SB 89 Summary

• Amends 21 O.S. 2011, Section 1761.1 regarding penalties for dumping trash on private or public property without consent.

• Increases maximum traffic citation amount for littering violations from $200 to $400, with penalties split equally between reward fund (50%) and county sheriff's service fee account (50%).

• Establishes enhanced penalties for discarding flaming/glowing substances or fire-causing materials: $2,000-$5,000 fine or up to 60 days imprisonment; increases to $4,000-$10,000 fine or up to 120 days during Governor-declared burn bans.

• Requires courts to order restitution, property cleanup, community service, and potential contributions up to $2,000 to reward fund in addition to fines.

• Effective July 1, 2013, with emergency clause allowing immediate implementation upon passage and approval.
