Increases the minimum distance setback for active vertically or horizontally drilled oil or gas wells from 125 feet to 500 feet from any occupied structure.

Establishes a 300-foot minimum radius requirement for active oil or gas wells from any producing freshwater well.

Prohibits wells using hydraulic fracturing techniques from locating within 2,000 feet of any occupied structure or producing freshwater well.

Defines "occupied structure" as any building requiring a certificate of occupancy or intended for human occupancy, including homes, schools, and hospitals.

Allows operators and surface owners to mutually agree to different setback distances, and permits surface owners to waive setbacks only for occupied structures or freshwater wells on their own property; effective November 1, 2015.
