HB 1110 Summary

• Creates the Vulnerable Adult Injury and Death Review Board within the Office of the Attorney General, effective until July 1, 2021, to review deaths and injuries of elderly and mentally or physically debilitated adults resulting from undocumented circumstances, error, negligence, or abuse.

• Board shall conduct case reviews, develop statistical information, make recommendations to improve state agency policies and procedures, and request access to hospital records, medical examiner reports, medical/dental records, emergency medical service records, and other relevant files.

• Board composition includes 11 members: five state officials (Long-Term Care Ombudsman, directors of Long-Term Care and Home Services divisions, Adult Protective Services director, and Chief Medical Examiner) plus six appointed members including a geriatrician, mental health professional, gerontologist, and advocates for older adults.

• Board members serve two-year terms without compensation but may receive travel reimbursement; board must meet at least quarterly and submit annual statistical reports by February 1 to state leadership and agencies.

• Amends Oklahoma Open Meeting Act to allow Board to conduct executive sessions for reviewing individual cases while keeping case discussions privileged and inadmissible as evidence.
