HB 1122 Summary

• County clerks must accept documents that meet legibility and reproducibility standards without charging additional fees for minor formatting defects like stray markings within margins.

• Documents containing more than 25 legal descriptions per page require an additional filing fee of $1.00 per description in excess of 25.

• County clerks shall accept nonconforming documents if they are original or certified copies, legible without magnification, xerographically reproducible, meet statutory requirements, and the filer pays the nonconforming document fee.

• Digitized images or electronic copies of original or certified documents satisfy original document requirements when submitted electronically under the Uniform Real Property Electronic Recording Act.

• The act becomes effective November 1, 2015, and applies to all documents accepted for filing including those filed before the effective date.
