HB 1124 Summary

• Amends Oklahoma child care facility licensing requirements to mandate criminal history record checks for owners, employees, residents, and individuals with unsupervised child access through Oklahoma State Courts Network searches, Child Care Restricted Registry searches, and national fingerprint-based criminal history searches.

• Establishes exceptions to national criminal history record search requirements for certain volunteers transporting children irregularly and specialized service professionals with parental/guardian written consent acknowledging the lack of completed background check.

• Requires national criminal history searches for existing facility personnel by November 1, 2016, with searches conducted by Oklahoma State Bureau of Investigation and Federal Bureau of Investigation including rap back notification of subsequent criminal activity.

• Prohibits individuals required to register under the Sex Offenders Registration Act from working in or residing at child care facilities; violations punishable by up to 5 years imprisonment and $5,000 fine, with additional penalties including emergency orders, license revocation, and administrative penalties up to $10,000.

• Effective November 1, 2015; directs Department to contract with statewide vendor for electronic fingerprint services supporting required national criminal history records searches.
