HB 1274 Summary

• Authorizes child care facilities to release background check information and other relevant employment-related information about potential employees to other child care facilities considering hiring the same individual, unless deemed confidential by state or federal law.

• Requires the same confidentiality standards and recordkeeping requirements apply to child care facilities receiving employee information as those required for the facilities releasing the information.

• Maintains existing background check requirements for child care facility employees, owners, residents, and volunteers, including Oklahoma State Courts Network searches, national criminal history records searches, and Sex Offenders Registration Act checks.

• Prohibits individuals required to register as sex offenders from working with or residing in child care facilities; violations are felonies punishable by up to 5 years incarceration and up to $5,000 in fines.

• Effective November 1, 2015.
