HB 1320 Summary

• Amends Oklahoma law governing termination of parental rights by changing age determination from "age at time of filing" to "age at time of placement" for children in foster care proceedings.

• Modifies grounds 16 and 17 for termination to reference a child's age at the time of placement rather than at the time the petition or motion for termination is filed.

• Ground 16 applies to children four (4) years of age or older at placement who have been in foster care for 15 of the most recent 22 months and cannot be safely returned home.

• Ground 17 applies to children younger than four (4) years of age at placement who have been in foster care for at least 6 of the preceding 12 months and cannot be safely returned home.

• Effective November 1, 2015.
