HB 1325 Summary

• Citizens age 21 or older, except convicted felons, may transport a pistol open and loaded or unloaded in a vehicle for self-defense without a handgun license, provided they are not involved in criminal activity.

• Citizens without a handgun license may leave a concealed, loaded pistol in a parked or unattended locked vehicle if they maintain legal control of the pistol when away from their residence or business.

• Law enforcement officers cannot disarm or physically restrain a person possessing an unconcealed weapon in a vehicle absent reasonable and articulable suspicion of other criminal activity.

• Transporting a loaded pistol without a valid handgun license during a traffic stop may result in a $70.00 traffic citation plus court costs, but firearms shall not be confiscated if the driver is age 21 or older or has a valid license.

• Act becomes effective November 1, 2015.
