HB 1370 Summary

• Requires all genetically engineered food and seed stock offered for retail sale in Oklahoma to display a conspicuous label stating "Produced with Genetic Engineering" on the package or shelf display.

• Prohibits genetically engineered food or seed stock from being labeled or described as "natural" and classifies non-compliant products as misbranded under existing state law.

• Exempts restaurants, alcoholic beverages, and medical food from disclosure requirements; also exempts producers who obtain sworn statements from suppliers confirming products are not knowingly genetically engineered.

• Allows packaged processed food with less than 0.9% genetically engineered content to remain exempt from labeling requirements until November 1, 2019.

• Establishes civil penalties of up to $1,000 per day per misbranded product per sales location for violations and directs the Oklahoma Department of Agriculture to develop an affidavit form for producers to certify non-genetically engineered products.
