HB1374 Summary

• Amends the Oklahoma Used Tire Recycling Act to allow the Department of Environmental Quality to use Recycling Indemnity Fund monies for other environmental program needs if air quality-related needs are satisfied, expanding fund use beyond air pollution control.

• Allocates 28% of fees from the $2.50 per tire charge to the DEQ Revolving Fund for air quality control, monitoring, enforcement, and other environmental needs.

• Establishes compensation rates for various tire recycling activities: $54/ton for processing, $53/ton for collection and transportation, $2.80 per large tire for erosion control, and $0.50 per tire for engineering projects using baled tires.

• Requires compensation recipients to comply with Oklahoma Used Tire Recycling Act requirements and demonstrate utilization of tires through sworn affidavits and documentation to the Department of Environmental Quality and Tax Commission.

• Effective November 1, 2015.
