HB 1408 Summary

• Amends Oklahoma law to exempt certain establishments from food establishment licensing requirements, including produce stands selling only whole uncut produce, manufacturers/wholesalers, private home kitchens preparing non-potentially hazardous food for nonprofit bake sales, and hotels providing limited food service.

• Expands exemptions to include bed and breakfasts with three or fewer guest bedrooms offering only breakfast, nonprofit organizations using unpaid workers for occasional fund-raising events (defined as four times per year or less), day care centers, nursing facilities, and residential care homes.

• Authorizes the State Board of Health to provide fee-exempt licenses to nonprofit civic, charitable, or religious organizations using unpaid persons to sell or offer food more frequently than occasional events, with licenses that do not expire unless affirmatively revoked or suspended.

• Permits the State Board of Health to establish rules allowing licenses for limited-duration or seasonal events to extend only for the term of the event or season, with adjusted fees accordingly.

• Takes effect November 1, 2015.
