Property owners may refuse installation and use of advanced metering infrastructure (AMI) meters by retail electric suppliers, subject to Corporation Commission conditions and requirements.

Corporation Commission must promulgate rules by April 1, 2016 establishing notice requirements, disclosure of AMI information (including service benefits, data collection capacity, and health impacts), and procedures for implementation.

Retail electric suppliers may implement a higher fixed charge for property owners who refuse AMI installation to recover full costs of serving those customers and prevent subsidization by AMI-adopting customers in the same service class.

Suppliers must file tariffs with the Corporation Commission for higher fixed charges, which the Commission must verify cover only necessary costs; tariffs terminate when differential costs no longer exist.

Self-regulated electric cooperatives may promulgate rules or procedures consistent with Commission rules established under this act; act takes effect immediately upon passage and approval.
