HB 1455 Summary

• Amends the Student Data Accessibility, Transparency and Accountability Act of 2013 to delete restrictions on accessing student data while adding new protections against linking, storing, and collecting student data across educational levels.

• Prohibits the State Board of Education and school districts from linking individual student data between early childhood education and K-12, between K-12 and postsecondary/workforce levels, or with data from other state agencies outside the State Department of Education.

• Requires school districts to obtain annual signed parental consent forms for any release of individual student data not otherwise required by law, and to retain copies of these forms.

• Prohibits the State Board of Education from entering into agreements or consortiums that cede control of state academic standards, and prohibits use of federal or out-of-state private funds to construct or expand statewide longitudinal data systems or comply with Executive Order 2013-40.

• Effective November 1, 2015, and requires existing state agreements or contracts that cede state control over academic standards, teaching standards, student assessment, or data collection to be amended to comply with these restrictions.
