HB 1456 Summary

• Prohibits municipalities from annexing land using connecting strips that serve no municipal purpose other than establishing statutory contiguity or capturing territory, constituting an impermissible exercise of state-delegated authority.

• Municipalities with population of 12,000 or less may only annex up to 8 square miles in one area at a time, requiring written consent of owners of at least 65% of the acres and 25% of the population to be annexed.

• Requires municipalities annexing territory without majority landowner consent to prepare a municipal services plan (water, sewer, fire protection, law enforcement) with completion within 120 months of annexation or the territory shall be detached.

• Requires municipalities to notify the Oklahoma Tax Commission and county commissioners prior to annexation, with certified mail notice to agricultural property owners (5+ acres) and adjacent county commissioners if territory encroaches upon another county.

• Provides prevailing property owners in annexation disputes the right to recover court costs and reasonable attorney fees, including cases where municipalities withdraw or revoke annexation ordinances in response to litigation.
