Peace officers may place written hold orders on precious metals or gems suspected of being stolen or embezzled, with initial hold orders not exceeding 30 days.

Hold orders must include dealer signature, officer identification, agency name and offense number, complete property description with model/serial numbers, reporting agency name, dealer mailing address, and expiration date.

Dealers may consent to release held property to law enforcement custody without waiving property rights, but otherwise cannot release property except by court order or after holding period expiration.

District attorney's office must notify dealers in writing within 15 days of case disposition and if criminal charges are filed that property may be needed as evidence.

Willful noncompliance with hold orders constitutes a violation of the Precious Metal and Gem Dealer Licensing Act; dealers may designate additional storage locations (vault or bank) subject to administrator approval and 30-day notice before termination.
