HB 1462 Summary

• Amends Oklahoma burn ban law (2 O.S. Section 16-26) to allow agricultural producers to burn cropland, range, or pastureland during county-declared extreme fire danger periods if specific procedures are followed.

• Agricultural producers must submit written applications to county commissioners, obtain written approval from local fire departments with suppression responsibility, construct adequate fire lines, and ensure adequate personnel and equipment are on hand to control fires.

• Requires agricultural producers to comply with notification procedures outlined in Section 16-28.2 of Oklahoma Statutes before burning.

• County commissioners may grant exceptions to fire prohibitions based on appropriate precautionary measures when declaring extreme fire danger periods lasting no more than 30 days without documented concurrence of a majority of municipal and certified rural fire department chiefs.

• Effective November 1, 2015.
