HB 1514 Summary

• Amends the Oklahoma Concentrated Animal Feeding Operations Act (2 O.S. 2011, Sections 20-41 and 20-46) to establish a two-stage hearing process for new animal feeding operation licenses.

• Department of Agriculture has 60 working days to review applications for physical and technical suitability, plus an additional 30 working days if additional information is requested.

• Establishes preliminary hearings before an administrative law judge where affected property owners (within 1 mile of facility) must meet burden of proof showing direct, substantial, and immediate effect on their legally protected interests.

• Affected property owners who meet burden of proof at preliminary hearing are entitled to full administrative hearing under the Administrative Procedures Act; those who fail to meet burden have application sent to State Board of Agriculture.

• Effective date: November 1, 2015.
