HB1580 Summary

• Amends 47 O.S. 2011, Section 2-117 to establish procedures for investigating traffic-related enforcement practices of municipal law enforcement agencies by the Commissioner of Public Safety.

• Allows the district attorney, county commissioners, State Auditor and Inspector, State Attorney General, or state legislators to request an investigation of a municipality's traffic enforcement if they believe practices are conducted for revenue generation exceeding 50% of the municipality's operational needs.

• Excludes speeding violations of 14 miles per hour or more over the speed limit from revenue calculations when determining if enforcement practices violate the statute.

• Requires the Attorney General to determine within 60 days whether enforcement practices violate the statute and directs the Commissioner to designate special traffic-related enforcement authority on federal-aid primary highways and state highway systems accordingly.

• Becomes effective November 1, 2015.
