HB 1613 Summary

• Enacts the "Access to Healthy Choices in Oklahoma Act" requiring the State Department of Health to regulate foods and beverages in vending machines on state property.

• Department must promulgate rules by November 1, 2016 establishing nutrition and food procurement standards consistent with federal GSA and HHS guidelines, with implementation by state agencies within one year.

• Standards must consider calories, portion size, saturated fat, trans fat, sodium, sugar, fruits, vegetables, and whole grains; apply 24 hours daily; and be reviewed and updated every 5 years.

• All vending machines and retail food establishments on state property must display nutritional labeling complying with 21 CFR Sections 101 and 109; existing contracts shall be renegotiated when possible, and future contracts must incorporate adopted standards with specific breach of contract language and enforcement provisions.

• Department shall designate a position to coordinate training, monitor compliance, and submit annual reports to the Commissioner; Department has final authority to determine if foods and beverages meet required standards; act becomes effective November 1, 2015.
