• When correctional facilities reach maximum capacity, the Department of Corrections must notify all county jails before contracting with private prison operators to provide housing for state inmates.

• County sheriffs have 3 business days after court orders judgment and sentence to transmit certified sentencing documents to the Department of Corrections by facsimile, electronic mail, or physical delivery.

• The Department of Corrections becomes responsible for inmate housing costs in county jails from the date judgment and sentence is ordered until the inmate is scheduled for transfer, with exceptions for inmates with pending charges in the same jurisdiction.

• Sheriffs must notify the Department when a county jail reaches capacity and must transport excess inmates to state facilities within 72 hours; the Department must schedule reception within 72 hours of notification unless other arrangements are made.

• Reimbursement rate for county jail housing increases from $24.00 to $27.00 per inmate per day effective January 1, 2007, with the state covering emergency medical care related to incarceration at Medicaid rates.
