HB 1750 Summary

• State Board of Health must promulgate rules defining "residential care home" as an establishment providing residential accommodations, food service, and supportive assistance to unrelated residents who are ambulatory and capable of managing their own affairs.

• Residents may receive home health skilled nursing services but cannot require 24-hour skilled nursing care, supervision, or intermediate care.

• Definition includes transitional living facilities and halfway houses as defined in Section 3-403 of Title 43A of the Oklahoma Statutes.

• Residential care homes may consist of multiple disconnected units or buildings if they share the same owner/operator, residents can ambulate between buildings, adequate safety measures exist, outdoor areas are maintained, buildings are within 175 feet of the main kitchen and dining room, and units are conveniently located for residents.

• Act becomes effective November 1, 2015.
