HB 1778 Summary

• Amends procedures for ad valorem tax sale of real property to exclude properties with Oklahoma Health Care Authority (OHCA) liens exceeding the property's assessed value from being bid off to the county.

• Requires county treasurers to provide OHCA with lists of properties to be sold at tax resales, and OHCA shall produce lists for each county showing properties on which it holds liens available to potential buyers.

• Authorizes OHCA to file lien releases on blighted properties as defined in Oklahoma Statutes Title 11, Section 38-101, upon request of the county treasurer, though such release does not extinguish the debt owed to OHCA.

• Protects counties from civil liability for pre-existing environmental problems on tax-acquired properties and from liability for remediation actions taken in a non-reckless and non-negligent manner.

• Effective date: November 1, 2015.
