OK HB1804

Establishes Oklahoma law governing delegates to a federal Article V amendment convention, codified as Section 26.43 of Title 75 of the Oklahoma Statutes.

Prohibits delegates from voting to allow consideration or approval of any "unauthorized amendment" (proposals outside the scope of Oklahoma's legislative application or instructions); violating delegates are immediately recalled by the Speaker and President Pro Tempore and replaced by alternates.

Requires all delegate and alternate candidates to take an oath swearing they will uphold the U.S. and Oklahoma constitutions and will not vote for unauthorized amendments.

Mandates the Oklahoma State Legislature certify to the convention the selection of delegates and alternates, any recalls and replacements, and nullification of any unauthorized votes cast.

Establishes criminal penalty of a misdemeanor fine up to $1,000 for any delegate who violates the oath; becomes effective November 1, 2015.
