Oklahoma Health Care Authority shall submit a waiver to the Center for Medicaid and Medicare Services for uncompensated care provided at Indian Health Service facilities, Native American tribal health facilities, and Urban Indian Organization health facilities.

Waiver will provide payments to these facilities for formerly reimbursable services and to cover otherwise uncompensated care.

Oklahoma Health Care Authority may take actions including any waivers authorized by federal law to perform obligations under agreements related to the waiver submission.

State of Oklahoma consent to agreements executed by Oklahoma Health Care Authority is deemed given to the extent required by federal law, tribal law, or other law affecting federally recognized Native American tribes.

Act becomes null and void if Oklahoma Health Care Authority is unable to obtain federal financial participation and waiver approval from the Center for Medicaid and Medicare Services.
