HB 2049 Summary

• Amends the Student Data Accessibility, Transparency and Accountability Act of 2013 to clarify that "student data" includes state and national assessment results, course information, grades, attendance, discipline reports, remediation, special education data, and demographic information, but excludes juvenile records, criminal records, medical records, Social Security numbers, and biometric information.

• Requires the State Board of Education to create and publish a data inventory, develop privacy compliance policies aligned with FERPA, establish data security plans, and conduct routine compliance audits to protect student information.

• Restricts access to student data to authorized state department staff, contractors, district administrators, teachers, students and parents, and other state agencies as required by law, while limiting public reports to aggregate data only.

• Prohibits transfer of confidential student data outside Oklahoma except for specific circumstances including out-of-state student transfers, attendance at out-of-state institutions, national assessments, voluntary programs, vendor contracts, and migrant student reporting.

• Requires school districts to obtain signed parental consent before requiring students to create individual web accounts or access websites requiring student-specific logins with personally identifiable information; effective November 1, 2015.
