HB 2082 Summary

• Amends Oklahoma law (10A O.S. 2011, Section 1-2-105) regarding child abuse and neglect investigations conducted by the Department of Human Services.

• Removes language requiring inquiry into "the child or" having a history of mental illness, requiring investigation into only persons responsible for the child's health, safety, or welfare.

• Requires Department of Human Services to give special consideration to risks of children with disabilities who are unable to communicate effectively about abuse, neglect, or safety threats.

• Requires Child Welfare Services to collaborate with Developmental Disabilities Services Division to implement a protocol for cases involving children with disabilities who have complex medical needs, including resource coordination and medical evaluation.

• Effective date: November 1, 2015.
