HB 2125 Summary

• Licensed architects and professional engineers who voluntarily provide design services during declared emergencies without compensation (except expense reimbursement) are granted immunity from liability for personal injury, wrongful death, property damage, or other losses related to their acts or omissions.

• Immunity does not apply to gross negligence, willful misconduct, or wanton misconduct in rendering emergency professional services.

• Immunity applies only to voluntary services occurring during the emergency or within 90 days after the emergency ends, unless extended by Governor's executive order.

• Out-of-state licensed architects or engineers who are members of a mobile support team may inspect and placard structures for safety and habitability upon request by the Governor without being licensed in Oklahoma, with the same immunity protections and limitations.

• Amends 76 O.S. 2011, Section 5.8 to clarify language and add definitions for building inspection officials, law enforcement officials, licensed architects, professional engineers, public officials, and public safety officials; effective November 1, 2015.
