HB 2126 Summary

• Prohibits the Oklahoma Water Resources Board from taking actions that would abrogate rights or privileges granted under Section 404 Clean Water Act permits issued by the U.S. Army Corps of Engineers.

• Prohibits the Oklahoma Water Resources Board, Department of Environmental Quality, and other state agencies from promulgating rules that extend the definition of "waters of the state" beyond the definition in Oklahoma Statutes Section 1-1-201, Title 27A.

• Prohibits the Board from evaluating interactions with surface waters when conducting hydrologic surveys and investigations for major or minor groundwater basins or subbasins.

• Prohibits the Board from considering interactions with surface waters when determining maximum annual yield for major or minor groundwater basins or subbasins.

• Declares an emergency effective date, making the act effective immediately upon passage and approval.
