HB 2218 Summary

• Peace officers may place a written hold order on gems or precious metals suspected of being stolen or embezzled when they have probable cause to believe a dealer possesses the property.

• Initial hold orders cannot exceed 30 days but may be extended in successive 30-day periods with written notification prior to expiration; hold orders expire automatically if not extended.

• Written hold orders must contain dealer signature, officer name and identification, agency name and offense number, complete property description, reporting agency name, dealer mailing address, and hold period expiration date.

• Dealers may voluntarily release property to law enforcement custody during a hold order without waiving property rights; dealers must retain property if the district attorney notifies them criminal charges have been filed and property is needed as evidence.

• Willful noncompliance with a written hold order constitutes a violation; the act becomes effective November 1, 2015.
