HB 2225 Summary

• Extends child support lien provisions to life insurance claims in addition to existing personal injury, wrongful death, and workers' compensation claims.

• Requires insurers to exchange information with Oklahoma Department of Human Services before remitting $500 or more on a claim to determine if claimants owe past due child support.

• Insurers must provide claimant information (name, address, date of birth, social security number) to the Department at least 10 business days before payment, either directly or by matching Department-provided data.

• Upon identifying a match for past due child support, the insurer must withhold the full amount and remit it to the Centralized Support Registry; child support liens are subordinate to claims for documented services, real property damage, and motor vehicle damage.

• Insurers failing to comply face penalties up to $10,000 and liability for unpaid child support; unauthorized disclosure of information constitutes a misdemeanor with fines up to $1,000 or up to one year imprisonment; effective date is November 1, 2015.
