HJR1005 Summary

• Direct shipment of wine from licensed wineries to consumers over 21 years old is authorized within and outside Oklahoma.

• Wineries producing no more than 10,000 gallons annually may sell and ship wine directly to retail package stores and restaurants in Oklahoma without using wholesale distributors.

• Small winemakers choosing direct distribution to retail establishments must use only vehicles owned or leased by the winemaker and cannot use common or private contract carriers.

• If any winemaker provision is ruled unconstitutional, no winemaker shall be permitted to directly sell wine to retail package stores or restaurants in the state.

• The amendment to Section 3 of Article XXVIII of the Oklahoma Constitution is submitted to voters with ballot language explaining the measure allows wine shipment by licensed wineries directly to consumers.
