Directs the Secretary of State to refer a proposed constitutional amendment to Oklahoma voters for approval that would create a new Court of Capital Appeals and amend Sections 1 and 4 of Article VII of the Oklahoma Constitution.

Grants the Oklahoma Legislature authority to set the composition of the Court of Capital Appeals, the election or appointment of judges, and judicial terms through statute.

Assigns exclusive appellate jurisdiction over capital murder cases to the Court of Capital Appeals and exclusive appellate jurisdiction over all other criminal cases to the Court of Criminal Appeals.

Authorizes the Court of Capital Appeals to issue, hear, and determine remedial writs including habeas corpus, mandamus, quo warranto, certiorari, and prohibition as provided by law.

Amendments become effective November 1, 2017, and requires the Chief Clerk of the House to file copies with the Secretary of State and Attorney General immediately after passage.
