SB 116 Summary

• Amends Oklahoma private prison regulations (57 O.S. 2011, Sections 563.2 and 563.3) to exempt certain requirements for private prison contractors operating under direct federal Bureau of Prisons contracts that house federal inmates with on-site federal monitoring.

• Exempts federally-contracted facilities from specific provisions including: inmate intake restrictions, emergency response plan approvals, certain facility monitoring requirements, and pre-transfer inmate information disclosures to the Department of Corrections.

• Maintains all other private prison regulations for contractors housing state or federal inmates without direct Bureau of Prisons contracts, including construction plan approvals, insurance requirements, emergency planning, and American Correctional Association accreditation.

• Requires private prison contractors with federal contracts to still comply with federal law (18 U.S.C. Section 4002) regarding use of federal inmates for public works projects and other applicable federal provisions.

• Declares an emergency clause making the act effective immediately upon passage and approval.
