Patients have the right to access their medical records from doctors, hospitals, and other medical institutions, including x-rays, photographs, images, and pathology slides.

Copy fees for patients requesting their own records are $0.50 per page (excluding x-rays/images at $5.00 each), with no charge for searching or retrieving records.

Requests from attorneys, insurance companies, and subpoenas are charged a $10.00 base fee plus per-page charges and postage/delivery fees; electronic records in digital form cost $0.30 per page with a maximum charge of $200.00 plus delivery fee.

Psychological, psychiatric, mental health, and substance abuse treatment records are excluded from these provisions and must be obtained under Section 1-109 of Title 43A of the Oklahoma Statutes.

The act becomes effective November 1, 2015.
