SB 129 Summary

• Amends 56 O.S. 2011, Section 237B to establish a child support data matching system between insurance companies and the Oklahoma Department of Human Services for claims of $500 or more.

• Requires insurers to exchange claimant information with the Department prior to payment to determine if the claimant owes past due child support, using either direct information submission or data matching with Department databases.

• Mandates insurers provide claimant name, address, date of birth, social security number, and other required information at least 10 business days before payment.

• Authorizes the Department to issue liens on insurance payments for child support obligations; insurers must withhold full past support amounts and remit to the Centralized Support Registry.

• Imposes penalties up to $10,000 for insurer non-compliance and misdemeanor penalties up to $1,000 fine or one year imprisonment for unauthorized disclosure of information; effective November 1, 2015.
