Commercial pet breeders are prohibited from locating within 2,500 feet of public or private schools or licensed day care facilities in municipalities with populations exceeding 300,000.

The prohibition does not apply to commercial pet breeders lawfully operating and in full compliance with all applicable licensing, permitting, and zoning requirements prior to the effective date.

Public officers are prohibited from issuing licenses, permits, approvals, or consent for new commercial pet breeders within 2,500 feet of schools or day care facilities in municipalities over 300,000 population.

Pending applications for commercial pet breeder licenses and permits are subject to the location prohibitions established by this act.

The term "commercial pet breeder" has the same meaning as given in Section 30.2 of Title 4 of the Oklahoma Statutes, and violations may be enforced through civil injunctions or municipal court prosecution.
