SB 167 Summary

• Prohibits registered sex offenders from loitering within 500 feet of schools, child care centers, playgrounds, or parks; violation is a felony punishable by up to $2,500 fine and one year county jail for first offense, or up to $2,500 fine and three years Department of Corrections for subsequent offenses.

• Prohibits habitual or aggravated sex offenders from entering any park; allows exemptions for custodial parents or legal guardians enrolling, delivering, or retrieving children at schools or child care facilities during regular hours with advance notice to administrators.

• Maintains existing 2,000-foot residency restriction for registered sex offenders around schools, educational institutions, child care centers, playgrounds, and parks operated by homeowners' associations or governmental authorities; clarifies distance measured from property line to property line.

• Prohibits registered sex offenders convicted of crimes against minors from residing with minor children, except parents, stepparents, or grandparents whose victim was a different child; violation is a felony punishable by $3,000 fine and one to three years imprisonment for first offense, or three years minimum for subsequent offenses.

• Effective November 1, 2015; exempts sex offenders receiving medical treatment at state-certified facilities and those attending religious worship with written permission from religious leaders.
