SB 184 Summary

• Amends Oklahoma sentencing law (22 O.S. 2011, Section 991a) to modify exceptions to suspended sentence provisions for the Elderly and Incapacitated Victim's Protection Program.

• Expands sentencing options available to courts when a defendant is convicted of a crime without a death sentence, including suspended sentence with or without probation, fines, confinement, restitution, community service, and treatment programs.

• Requires courts to consider restitution to victims as the first option when sentencing, and prohibits suspension of sentences for certain repeat felony offenders except under specific conditions or with written district attorney approval.

• Establishes DNA testing requirements for persons convicted of felonies subject to sex offender registration and certain misdemeanor offenders, with procedures for sample collection and submission to the OSBI Combined DNA Index System (CODIS) Database.

• Becomes effective November 1, 2015.
