SB 216 Summary

• Amends requirements for documents recorded by county clerks, modifying margins and font specifications to require top margins of at least 1.5 inches and other margins of at least 1 inch, with minimum 10-point font.

• Allows county clerks to accept nonconforming documents that fail subsection B requirements if they are legible without magnification, xerographically reproducible, and meet all other statutory requirements upon payment of an additional fee.

• Permits digitized images or electronic copies of original or certified documents to satisfy recordation requirements when submitted electronically through the Uniform Real Property Electronic Recording Act.

• Exempts plats, Uniform Commercial Code filings, and documents created by federal, state, and local government entities from the new requirements.

• Effective July 1, 2015, with emergency clause for immediate implementation.
