ENGROSSED SENATE BILL NO. 259

• Reduces the maximum fine for truck overweight violations from $500 to $200 per violation for motor carriers, private carriers, and persons assisting in such violations.

• Requires the Oklahoma Corporation Commission to establish rules treating overweight violations as contempt of motor carrier regulations, with grounds for temporary or permanent cancellation of operating authority.

• Directs the Commission to consider violation frequency, pattern of violations, fleet size, type of operation, and amount of overweight when establishing enforcement rules.

• Exempts motor carriers, private carriers, shippers, and persons loading vehicles from fines unless the gross weight exceeds 5,000 pounds overweight.

• Becomes effective November 1, 2015.
